THE 24-HOUR CHALLENGE
LIABILITY WAIVER

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (“AGREEMENT”) In consideration of participating in programs with The Mission I’m Possible at Temescal Gateway Park, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “releasees” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity. I hereby release, discharge, and covenant not to sue The Mission I'm Possible, Mountains Recreation and Conservation Authority, Rancho Simi Recreation and Park District, Conejo Recreation and Park District, Santa Monica Mountains Conservancy & Alton Biz Development, LLC,  its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the “RELEASEES” herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the “releasees” or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim. The Mission I’m-Possible urges me to obtain a physical examination from a doctor before participating in this event IF I feel the need. I agree that by participating in this physical activity, is at my own risk. I recognize that any activity or exercise is not without some risk to the musculoskeletal system (e.g. sprain, strain) and cardiorespiratory system (e.g. dizziness, fainting, abnormal heartbeat, discomfort in breathing, abnormal blood pressure response, and in rare instances, heart attack or stroke).  I acknowledge that not all risks can be known in advance.

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, “Releasor,” “I” or “me”, which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity.

I HEREBY release and forever discharge Mission I’m Possible, Mountains Recreation and Conservation Authority, Rancho Simi Recreation and Park District, Conejo Recreation and Park District, Santa Monica Mountains Conservancy & Alton Biz Development, LLC, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively “Releasees”), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney fees and any related costs.

POLICY REVIEW AND PHOTO RELEASE I have received a copy of The Mission I'm Possible, Mountains Recreation and Conservation Authority, Rancho Simi Recreation and Park District, Conejo Recreation and Park District, Santa Monica Mountains Conservancy & Alton Biz Development, LLC, ’s Rules and Policies and have had a review of policies with a Mission I’m Possible staff member. I understand that The Mission I'm Possible, Mountains Recreation and Conservation Authority, Rancho Simi Recreation and Park District, Conejo Recreation and Park District, Santa Monica Mountains Conservancy & Alton Biz Development, LLC, ’s Rules and Policies are subject to change and that updated policies will be posted on site and published to the The Mission I'm Possible, Mountains Recreation and Conservation Authority, Rancho Simi Recreation and Park District, Conejo Recreation and Park District, Santa Monica Mountains Conservancy & Alton Biz Development, LLC,  website. I am aware that individual and group publicity photos and videos are taken from time to time and in consideration for me or my child(ren)’s participation I hereby grant my permission for my own and/or my child’s likeness to be used in The Mission I'm Possible, Mountains Recreation and Conservation Authority, Rancho Simi Recreation and Park District, Conejo Recreation and Park District, Santa Monica Mountains Conservancy & Alton Biz Development, LLC,  publicity or advertising.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize Mission I’m-Possible to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel.

I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. In the event that any damage to equipment, field or facilities occurs as a result of my or my family’s or my agent’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness. Both participant and Mission I’m Possible agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted altering or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
